Effective Date: October 1, 2026
Version: 2026-10-01
Last Updated: October 16, 2026
These Terms of Service ("Terms") are an agreement between Trades Operator, LLC ("Trades Operator," "we," "us," or "our") and the business that signs up for or uses Trades Operator ("Customer," "you," or "your"). They cover our websites, web and mobile applications, integrations, communications features, AI features, and related support (together, the "Service").
1. Agreement and Eligibility
By creating an account, starting a subscription, or using the Service, you agree to these Terms. If you accept on behalf of a company, you confirm that you have authority to bind that company. If you do not agree, do not use the Service.
If you and Trades Operator have signed a separate written agreement or order form for the Service, that document controls where it conflicts with these Terms.
Trades Operator is business software for home-service and trade companies. You must be at least 18 years old and use the Service for business purposes, not personal, family, or household purposes.
The Service helps you run calls, contacts, jobs, scheduling, estimates, invoices, payments, accounting records, reporting, and customer communications. It does not provide legal, tax, accounting, payroll, code-compliance, lending, or financial advice. You remain responsible for your business decisions and for any professional review your business needs.
2. Accounts and Users
You are responsible for your account and for everything done under it, including by the users you invite.
- Keep account information accurate and current.
- Give each person their own login, and give users only the access their role needs.
- Protect passwords and use two-step login where the Service requires it.
- Tell us promptly at support@tradesoperator.com if you suspect unauthorized access.
Some sensitive actions may require extra verification, an owner or admin role, or a recent two-step login.
3. Plans, Fees, and Billing
3.1 Subscription
The Service is sold as a monthly subscription for each company account. The subscription fee is billed monthly in advance and renews automatically each month until you cancel. There is no free trial.
3.2 Operator Credits
Some features use Operator Credits, which measure usage such as outbound texts and calls, phone numbers, call transcription, AI assistant activity, and certain email sends. The app shows which features use credits and your current balance.
- You can buy prepaid credit packs. Usage is drawn from your prepaid balance first.
- If your balance runs out, we may allow a limited grace amount so work is not interrupted. Usage beyond your prepaid balance is billed monthly in arrears.
- You can turn on automatic top-up, which buys the credit pack you choose when your balance runs low. You can turn it off at any time.
- Credits have no cash value, cannot be transferred, and are not refundable except where required by law.
3.3 Current Prices
As of the effective date, the subscription is $299 per month per company and Operator Credits cost $0.05 each. The prices shown in the app or on your order form at the time of purchase apply. We may change prices with at least 30 days' notice. A price change takes effect at your next billing period after the notice period ends.
3.4 Payment Method
You authorize us and our payment processor, Stripe, to charge your payment method on file for subscription fees, credit packs, automatic top-ups you turn on, and usage billed in arrears. Keep a valid payment method on file.
3.5 Taxes
Prices do not include taxes. You are responsible for sales, use, and similar taxes on your purchases, other than taxes on our income. Where we are required to collect tax, we will add it to your invoice.
3.6 Late or Failed Payments
If a payment fails, we will notify you and may retry the charge. If an amount is still unpaid 10 days after we notify you, we may suspend paid features or the account until it is paid. Suspension does not delete your data. We restore access after payment.
4. Cancellation and Refunds
You can cancel your subscription at any time by contacting support@tradesoperator.com or through billing settings where available. Cancellation takes effect at the end of the current paid month, and you keep access until then.
Fees already paid are not refundable, and we do not give credits or refunds for partial months, unused features, or unused credits, except where required by law or where we state otherwise in writing. Usage through the end of your subscription is billed on your final invoice.
5. Your Data
5.1 Ownership
You own the data you and your users put into the Service or import into it, including customer, job, financial, and communication records ("Customer Data").
5.2 How We Use Customer Data
You give us permission to host, copy, process, transmit, and display Customer Data as needed to provide, secure, support, and improve the Service, including through the service providers and integrations described in these Terms and our Privacy Policy. We do not sell Customer Data. We may use aggregated or de-identified information that does not identify you or any person to operate and improve the Service.
5.3 Your Responsibilities
You are responsible for the accuracy of Customer Data and for having the rights, notices, and consents needed to collect it and to have us process it, including data about your customers, employees, technicians, vendors, and leads.
5.4 Privacy, Subprocessors, and Data Processing
Our Privacy Policy at https://app.tradesoperator.com/privacy explains how we handle personal information. We use third-party service providers (subprocessors) for hosting, databases, payments, phone and text delivery, transcription, AI, email, and error monitoring. For personal information in Customer Data about your customers, employees, and leads, you are the controller (or business) and we act as your processor (or service provider) under applicable U.S. state privacy laws. We process it only on your instructions to provide the Service, keep it confidential, and do not sell or share it. A current list of subprocessors and a data processing agreement are available on request at support@tradesoperator.com.
5.5 Security
We use reasonable administrative, technical, and physical safeguards designed to protect Customer Data. No system is perfectly secure. If we confirm a security incident that affects your Customer Data, we will notify you without undue delay and as required by law.
6. Data Export, Termination, and Deletion
6.1 Export
You can export your data while your account is active. Until the in-app full-account export is available, we will provide a full export of your Customer Data on request at support@tradesoperator.com.
6.2 After Your Account Ends
For 30 days after your account is canceled or terminated, you can ask us for an export of your Customer Data. After that period we may delete Customer Data under our retention practices. Some records are kept longer where needed for legal, tax, accounting, payment, dispute, security, or audit purposes, and copies may remain in backups until they roll off. Our Data Deletion page at https://app.tradesoperator.com/data-deletion explains how to request deletion.
7. Phone Calls, Texts, Recording, and Email
7.1 Your Compliance
If you use the Service to call, text, email, or record conversations, you are responsible for following the laws and carrier rules that apply to you. That includes consent, opt-out handling, call-recording notice and consent, telemarketing and Do Not Call rules, the Telephone Consumer Protection Act, CAN-SPAM, and carrier A2P 10DLC requirements. The Service includes consent tracking and opt-out tools, but they do not replace your own legal review. You alone are responsible for the consent you collect from your own customers and for the content and timing of messages you send, and you will indemnify us as described in Section 19 for claims arising from them.
7.2 Business Texting Registration
Business texting in the United States requires A2P 10DLC registration. You agree to give accurate business information for registration and to send only the kinds of messages your registered campaign allows. Carriers or registries may reject, delay, or filter messages, and may charge registration or carrier fees that we pass through as shown in the app or on your invoice.
7.3 Call Recording and Transcripts
If you turn on call recording or transcription, you are responsible for giving any notice and getting any consent the law requires before a call is recorded or transcribed.
7.4 Phone Numbers
Phone numbers we provide are assigned for your use while your account is active and in good standing. When your account ends, we may release numbers we provided. Ask us before cancellation if you want to transfer a number out, and we will help where the carrier allows it.
8. Payments You Collect from Your Customers
If you collect payments from your customers through the Service, those payments are processed by Stripe through a Stripe connected account in your business's name. By setting up payments, you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (https://stripe.com/legal/connect-account). Stripe may require identity and business verification before you can accept payments or receive payouts.
You are responsible for your prices, invoices, taxes, refunds, disputes, chargebacks, and the disclosures you give your customers. Trades Operator is not a party to your transactions with your customers, does not hold your customers' funds, and is not a bank or money transmitter. Financing options shown in the Service are handoffs to third-party providers, and their terms apply.
9. AI Features
The Service includes AI features that draft messages, summarize calls, answer questions, suggest next steps, and prepare records. AI output can be incomplete or wrong. Review AI output before you rely on it, send it to a customer, post accounting entries, change schedules, or take payment action. Actions that change records or contact customers require your approval unless you turn on an automation that acts for you.
We do not opt in to allow our AI providers to train their models on Customer Data. AI features are not a substitute for professional judgment: do not rely on AI output as legal, tax, accounting, or code-compliance advice, and do not use it as the sole basis for decisions that significantly affect a person, such as hiring or firing. You are responsible for what you approve and send.
10. Third-Party Services and Imports
The Service connects to third-party services you choose to use, such as QuickBooks, Stripe, Twilio, Google, Meta, Plaid, and other software you import from. Your use of those services is governed by their own terms, and you authorize us to access and exchange data with them on your behalf. We are not responsible for third-party services, their availability, or changes they make.
Imports from other systems, including QuickBooks, copy your existing records into the Service. Review imported records before relying on them.
11. Acceptable Use
You may not, and may not let anyone else:
- Use the Service to break the law or to send unlawful, deceptive, harassing, or unwanted messages or calls.
- Upload malware or content you do not have the right to use.
- Access another company's data, probe or bypass security controls, or interfere with the Service.
- Scrape, copy, resell, or reverse engineer the Service, except where the law allows despite this limit.
- Overload the Service or use it in a way that harms other customers, carriers, or our providers.
- Use the Service or its AI output to build or train a competing product or model, or to create content that is unlawful, deceptive, or infringing.
- Send messages without the consent the law requires, or keep texting or calling people who have opted out or asked you to stop.
- Store payment card numbers, bank login credentials, Social Security numbers, health records, or similar sensitive data outside the fields built for them.
We may remove content or limit features that violate these Terms.
12. Beta Features and Design Partners
We may offer features labeled beta, preview, or early access. They are provided as-is, may change or be removed, and may have usage limits. Design partners who joined under a separate written arrangement keep the pricing and terms of that arrangement where it differs from these Terms.
13. Service Changes and Availability
We improve the Service continually and may add, change, or remove features. If we remove a feature that materially reduces the paid Service, we will give reasonable notice. We work to keep the Service available, but it may be interrupted by maintenance, provider or carrier outages, internet problems, or events outside our control. Keep your own business continuity practices for critical work.
14. Suspension and Termination
We may suspend or terminate your access if you materially breach these Terms and do not fix it within 10 days of our notice, if you do not pay as described in Section 3.6, or immediately if your use creates a security risk, violates law or carrier rules, or could harm Trades Operator, other customers, our providers, or the public. Where practical, we will tell you before or promptly after we suspend access and work with you to restore it.
You may stop using the Service and cancel at any time as described in Section 4.
15. Confidentiality
Each of us may receive non-public information from the other. The receiving party will use it only to perform under these Terms, protect it with reasonable care, and share it only with people and providers who need it and are bound to protect it. This does not apply to information that is public, already known, independently developed, or lawfully received from someone else. Either party may disclose information when required by law, after giving notice where allowed.
16. Intellectual Property and Feedback
We and our licensors own the Service, including its software, design, and content, other than Customer Data. While your subscription is active, we give you a limited, non-exclusive, non-transferable right to use the Service for your internal business operations under these Terms.
If you send us ideas or feedback, we may use them without obligation to you.
17. Warranty Disclaimer
Except as expressly stated in these Terms, the Service is provided "as is" and "as available." To the fullest extent permitted by law, Trades Operator disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, that AI output will be accurate, or that messages and calls will be delivered.
18. Limitation of Liability
To the fullest extent permitted by law:
- Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, even if told they were possible.
- Each party's total liability arising out of or relating to these Terms or the Service is limited to the amounts you paid to Trades Operator for the Service in the 12 months before the event that gave rise to the claim.
These limits do not apply to your payment obligations, to either party's indemnification obligations, or to liability that cannot be limited by law.
19. Indemnification
You will defend and indemnify Trades Operator against third-party claims, and related losses and reasonable costs, arising from your Customer Data, your calls, texts, emails, and recordings, your transactions with your customers, or your violation of these Terms or the law.
We will defend and indemnify you against third-party claims that the Service, as we provide it, infringes that party's United States intellectual property rights, and pay resulting damages and reasonable costs. This does not cover claims caused by Customer Data, third-party services, or use of the Service in violation of these Terms.
The party seeking indemnity must notify the other promptly, let it control the defense, and reasonably cooperate.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Before filing a claim, each party agrees to try to resolve the dispute informally by contacting the other and negotiating in good faith for 30 days. If the dispute is not resolved, it will be decided exclusively in the state or federal courts located in Denver, Colorado, and each party consents to those courts. Either party may bring a qualifying claim in small claims court or seek an injunction to protect its confidential information or intellectual property.
21. Changes to These Terms
We may update these Terms. For material changes, we will give at least 30 days' notice by email to the account owner or by notice in the app before the change takes effect. The version date at the top identifies the current Terms. If you keep using the Service after a change takes effect, you accept the updated Terms. If you do not agree, you may cancel before the change takes effect.
22. General Terms
- Notices: We send notices to the account owner's email address or in the app. Send notices to us at support@tradesoperator.com.
- Assignment: You may not assign these Terms without our written consent, except to a successor of your business that agrees to them. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Entire agreement: These Terms, our Privacy Policy, and any order form or signed agreement are the entire agreement about the Service and replace earlier terms about it.
- Force majeure: Neither party is liable for delays caused by events outside its reasonable control, other than payment obligations.
- Severability and waiver: If part of these Terms is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver.
- Independent parties: The parties are independent contractors. These Terms create no partnership, agency, or employment relationship and no third-party beneficiaries.
- Survival: Sections on fees owed, your data, confidentiality, intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive the end of these Terms.
23. Text Messaging Programs
Trades Operator messaging programs send recurring customer-care text messages about bookings, appointments, technician arrivals, estimates, invoices, scheduling changes, and service follow-up on behalf of the businesses that use Trades Operator. If you separately opt in on our website, Trades Operator may also send recurring informational and marketing text messages about your demo request and Trades Operator products, no more than four messages per month under that website opt-in.
Message frequency varies. Message and data rates may apply. Reply HELP for help or contact support@tradesoperator.com. Reply STOP to unsubscribe. If you opt out and later want to receive messages again, complete the same consent process again. Carriers are not liable for delayed or undelivered messages.
Messaging consent is not a condition of purchase. Mobile information and text-message consent are not sold or shared with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy at https://tradesoperator.com/privacy for how mobile information and consent are handled.
